MARY BRYAN (2.10) is the daughter of Samuel Bryan and Margaret (Morrow) Bryan.  Mary Bryan (and several other known children of Samuel Bryan) were not listed in the will of Mary’s father, Samuel Bryan.  The 1909 letter by Wash Bryan (born 1824) states that his “grandfather (Samuel Bryan) had five sons: Henry, William, James, Samuel and John; and four daughters: Becky, Betsey, Sarah and Mary.”  He continues by stating that “one daughter married Joe Pinkerton, another Sam Pinkerton, another married Webb, and another Joseph P. Wyles and lives in Missouri.”  Unfortunately, four daughters were listed separately and four son-in-laws are mentioned (and no mention of any Orton marriage).  However, the estate settlement of Mary’s brother, Henry Bryan, proves beyond any doubt that Mary is the son of Samuel Bryan and Margaret Bryan.  According to the 1830 census, Mary was born between 1775 and 1794.  Since Mary married in 1810, it is estimated that Mary was born around 1790 in North Carolina.  On November 6, 1810, “Polly” Bryan married Joseph Orton in Davidson County, Tennessee.  According to the 1820 census of Williamson County, Tennessee, Joseph was born between 1775 and 1794 and that Joseph had seven children in 1820.  According to Myrna Madigan, Joseph Orton was born on January 15, 1779 in Rowan County, North Carolina (if this birtdate is accurate then Mary Bryan may have been earlier than 1790).  Joseph could be the son of Joseph Orton and Jannet (Bryan) Orton (1.5) but proof is not conclusive.  Joseph Orton, Samuel Orton (possible brother of Joseph Orton) and David Pinkerton (possible brother-in-law of Joseph Orton) enlisted into the Second West Tennessee Militia from Williamson County, Tennessee.  They served in the War of 1812 and participated in the Battle of New Orleans.  Joseph Orton’s service is documented in a Bounty Land Warrant Number 3829 in Illinois.  It states that Joseph served in Lieutenant Gunter’s Company, Colonel Carroll’s Regiment, Tennessee Militia.  The estate records of Henry Bryan (ca. 1851) indicate that Joseph and Mary Orton had the following eight heirs:

   Jane Orton (who married Harrison Stark)
   Nancy Orton (who married Thomas Branning)
   Mary Orton (who married Thomas Lakin)
   Sarah Orton (who married Willis Branning)
   Rebecca Orton
   James M. Orton
   Henry Orton
   Eliza J. Orton (Samuel Pinckterton listed as guardian of minor)

According to the last distribution of funds (1866) from the estate of Joseph Orton, Joseph Orton had the following ten heirs:

The exact relationship of Eliza J. Orton to Joseph Orton presents challenging issues.  At first glance, it would be very easy to conclude that Eliza (Orton) Ridge was the youngest daughter of Joseph and Mary Orton (there is a still a remote chance of this being true).  If Eliza J. Orton was the daughter of Joseph Orton, why would Samuel Pinkerton (believed to be the uncle of Eliza J. Orton) become the guardian of Eliza J. Orton around 1851 when Joseph Orton was still living?  Other sources imply that Eliza (Orton) Ridge was the only daughter of Samuel R. Orton, a son of Joseph Orton who died shortly after the birth of his only child (if there were other siblings, their father’s share would have been divided among them).  There is a Samuel R. Orton who married Anna Pinkerton on December 22, 1835 in Davidson County, Tennessee.  According to John Dorroh, Samuel R. Orton died in Davidson County, Teneessee in 1837.  There is also a Anna Orten who married Cager Stark on September 5, 1844 in Greene County, Illinois.  The 1850 census of Greene County, Illinois (according to John Dorroh) shows Eliza Orton living with Cager and Anna Stark which greatly strengthens this connection.  However, just one year later (possibly two or three years later as the exact date of the chancery court records of Henry M. Bryan are not certain), why does Eliza Orton require a guardian when her mother, Anna (Pinkerton) Orton / Stark, is still living?  At first glance, the obvious answer is that Anna (Pinkerton) Orton / Stark must have died between 1850 (census record) and 1853 (the latest estimated date of the chancery court records of Henry M. Bryan).  Guardianship is not only taking care for the day to day needs of children of minor age but is also used to allow other adults to be legal representatives of minor children where parents are unable to provide that role.  Eliza and her mother, Anna, remained in Greene County, Illionois and Samuel Pinkerton remained in Davidson County, Tennessee during these court proceedings.  Anna (Pinkerton) Orton / Stark had no financial interest in Henry M. Bryan - but her daughter, Eliza did have a claim via her father’s (Samuel R. Orton) share.  This is probably a case of Samuel Pinkerton assisting his sister obtain funds for Anna’s daughter, Eliza.  The brother of Anna Pinkerton, Samuel Pinkerton, probably even more interest in the estate of Henry M. Bryan than his relationship with his sister, Anna.  The 1847 deed, where Henry M. Bryan purchased 114 acres of land and was later listed in his estate, lists Samuel Pinkerton as a neighbor.  The deed states “thence west with Samuel Pinkerton line fifty-two poles to a sugar tree.”

The second challenge was to identify the Joseph Altum that was listed as both a heir (probably representing the children of his his deceased wife, Margaret) and as a guardian in the estate of Joseph Orton (1866).  However, why are these heirs missing from the estate of Henry M. Bryan (1851)?  Margaret Orton married George M. Pickard on August 1, 1833 in Williamson County, Tennessee.  On November 28, 1838, Joseph Orton was appointed guardian of the minor heirs of the estate of George M. Picard - this implies that Margaret was a daughter of Joseph Orton.  Margaret Pickard married Joseph “Aultom” on September 6, 1838 in Greene County, Illinois (believed to be Margaret (Orton) Pickard, widow of George M. Pickard).  Joseph Altum is the only man listed that does not have the surname of Orton in the 1866 estate settlement of Joseph Orton.  Joseph is listed as both a heir (probably representing the children of his deceased wife, Margaret) and as a guardian for heirs.  This implies that Margaret (Orton) Pickard / Altum died prior to 1866.  Therefore, Joseph Altum would qualify for one share as a guardian for the children of Margaret (Orton) Pickard and would qualify for one share as the guardian of the children by Joseph Altum and Margaret (Orton) Pickard / Altum.  Margaret heirs should have been entitled only to one share that would be equally divided among all of her children (no matter how many marriages).  Joseph may have received two shares because of two young families that he took responsibility for and no one was aware of what the heirs of Margaret (Orton) Pickard / Altum should receive.  Another possibility is that Joseph Altum was the guardian for other minor children of sibling of Margaret (Orton) Pickard / Altum.  According to Sharon Eckstein, a descendant of Mary (Orton) Lakin, Joseph Altum was the guardian for the minors of Mary (Orton) Lakin as well (there are no court records located to date indicating this).

The third minor challenge was to indentify what happened to Mary (Orton) Lakin between 1851 and 1866.  The obvious scenario is that Mary (Orton) Lakin died prior to 1866 and that Thomas and Mary Lakin had no children.  Again, the obvious conclusion is not correct as Thomas and Mary Lakin had at least three daughters that were still living in 1866 (they were omitted from the estate of Joseph Orton for some reason).  A fourth minor issue is that William Orton was for some reason not included in the estate of Henry M. Bryan when he would obviously qualified for a share.  From the above research, Joseph and Mary Orton were the parents of at least ten children:

In 1820, Joseph Orton was living in Williamson County, Tennessee.  From 1840 to 1860, Joseph Orton was living in Greene County, Illinois.  According to Myrna Madigan, Joseph Orton died on May 28, 1864 in Greene County, Illinois.  On June 10, 1858, Rebecca Orton married Robert Jackson in Greene County, Illinois.

SAMUEL R. ORTON (2.10.1) is the son of Joseph Orton and Mary (Bryan) Orton.  Samuel was born in 1811 in Tennessee.  For a detailed desciption of the research that connects Samuel Orton to his father, Joseph Orton, see the sketch of Joseph Orton.  On December 22, 1835, Samuel R. Orton married his first cousin, Anna Pinkerton (2.9.1), in Davidson County, Tennessee.  Anna is the daughter of David Pinkerton and Jane (Bryan) Pinkerton.  Samuel and Anna Orton were the parents of at least one daughter:

According to John Dorroh, Samuel R. ELIZA JANE ORTON (2.10.1.1) is the daughter of Samuel R. Orton and Anna (Pinkerton) Orton.  Eliza was born in 1835 in Tennessee.  In 1850, Eliza Jane “Stark” (born 1837 in Tennessee) was living in Greene County, Illinois with Cager and Anna Stark.  On September 16, 1856, Eliza Orton married John Ridge in Greene County, Illinois.  John and Eliza Ridge were the parents of at least five children:

   Finus Ewen Ridge, b. February 25, 1858
   Charity Anna Ridge, b. November 7, 1859
   James Robert Ridge, b. March 4, 1862
   William David Ridge, b. October 28, 1864
   Louis Franklin Ridge, b. February 20, 1868

Finus Ridge died in an accident when he fell on a pitchfork in 1875.  Charity Ridge married a Mr. Saragent.  Charity (Ridge) Sargent died on March 27, 1942.  Jeannie (Sargent) Kipp is the great granddaughter of Charity (Ridge) Sargent.

MARGARET M. ORTON (2.10.2) is the daughter of Joseph Orton and Mary (Bryan) Orton.  Margaret was born in 1813 inTennessee.  On August 1, 1833, Margaret Orton married her cousin, George M. Pickard (51.6.7), in Williamson County, Tennessee.  George was previously married to the aunt of Margaret Orton, Nancy Bryan and they had one daughter: Nancy Bryan Pickard.  For additional information on the descendants of George and Nancy Pickard, see the sketch of Nancy Bryan (2.12).  George was born on September 22, 1807 in Orange County, North Carolina and is the son of Alexander Pickard and Jane (Morrow) Pickard.  The 1838 guardianship papers of George M. Pickard’s children and the 1851 estate distribution records of Henry M. Bryan indicate that George and Margaret Pickard were the parents of three children:

Pickard).  On September 6, 1838, Margaret “Pickard” married Joseph “Aultom” in Greene County, Illinois.  Joseph was born in 1819 in Tennessee.  Joseph Altum was previously married to Mary Lee on March 17, 1836 in Greene County, Illinois.  On November 28, 1838 (the following month after Margaret again), Joseph Orton was made the guardian of all four children of George M. Pickard, one daughter by his sister-in-law, Nancy (Bryan) Pickard, and three children by his daughter, Margaret (Orton) Pickard.  Joseph and Margaret Altum were the parents of at least seven children:

In 1840, 1860 and 1870, Joseph and Margaret Altum were living in Greene County, Illinois.  On September 18, 1878, James and Margaret Altum purchased lots in the town of Greenfield, Illinois.  Margaret (Orton) Pickard / Altum died between 1878 (known deed with husband) and 1880 (not found in census with husband).  In 1880, Joseph Altum was living in Greene County, Illinois.  On February 3, 1881, Joseph Altum married a third time to Kate Hopper in Greene County, Illinois.  Kate (Hopper) Altum died on December 3, 1884 and was buried in the Hardin Cemetery in Greene County, Illinois.  On February 3, 1885, Joseph Altum married a third time to Ann E. Grills in Greene County, Illinois.  Joseph H. Pickard died as a teenager on January 18, 1849 in Greene County, Illinois and was buried in the Hardin Cemetery.  In 1860, “Alex” Pickard was living with his sister and her husband, Andrew and Nancy Norris.  Alexander E. Pickard died on May 28, 1867 in Greene County, Illinois and was buried there in the Hardin Cemetery.  On February 28, 1861, Mary Jane Pickard married James B. McIllheran in Greene County, Illinois.

James Altum died on May 12, 1863 in Greene County, Illinois and was buried there in the Hardin Cemetery.  George Altum died on September 30, 1844 and was buried in the Hardin Cemetery in Greene County, Illinois.  The infant daughter of Joseph and Margaret Altum died at the age of two weeks on September 29, 1844 and was buried in the Hardin Cemetery in Greene County, Illinois.  On January 3, 1866, Effelbert Altum married Rebecca McDonald in Greene County, Illinois.  On October 8, 1874, Effelbert Altum married a second time to Sarah E. Marmon in Greene County, Illinois

Smith in Greene County, Illinois.  Mary was born in 1845 in Tennessee.  William and Mary Altum were the parents of at least five children:

ORTON (2.10.3) is the son of Joseph Orton and Mary (Bryan) Orton.  William was born in 1815 in Tennessee.  On June 28, 1849, William Orton married Martha Ann Harber in Greene County, Illinois.  Martha was born in 1829 in Kentucky and is the daughter of William Harber and Frances (Brannan) Harber.  Frances Brannan is the daughter of Dudley Brannon and Mary “Polly” Brannan.  Frances Brannon’s brother, Willis Brannan, married the sister of William Orton, Sarah Orton.  Frances Brannon’s brother, Thomas Brannan, married the sister of William Orton, Nancy Orton.  In 1850 and 1860, William and Martha Orton were living in Greene County, Illinois.  William and Martha Orton were the parents of at least four children:

   Mary V. Orton, b. 1851, Illinois
   Josephus Orton, b. 1854, Illinois
   Isaac Orton, b. 1855, Illinois
   Rosetta Orton, b. 1860, Illinois

William H. Orton died on November 12, 1881.

JAMES M. ORTON (2.10.4) is the son of Joseph Orton and Mary (Bryan) Orton.  James was born in 1817 in Tennessee.  In 1860, James M. Orton was living in the same household as James T. Starks in Greene County, Illinois.  On Septemer 3, 1864, James Orton married Margaret A. Lakin in Macoupin County, Illinois.  Margaret was born in 1838 in Illionois and is the daughter of Alexander Lakin (born 1813 in Ohio) and Maria Lakin (born 1813 in Kentucky).  James and Margaret Orton were the parents of at least two children:

James M. JAMES FRANKLIN ORTON (2.10.4.1) is the son of James M. Orton and Margaret A. (Lakin) Orton.  James was born on January 25, 1867 in Greene County, Illinois.  On April 8, 1891, James Orton married Drucilla Waltrip.  Drucilla was born on April 1, 1876 and is the daughter of Leo Waltrip and Mary (Bunton) Waltrip.  James and Drucilla Orton were the parents of four children:

   Roscoe Charles “Rocky” Orton, b. October, 1894, Illinois
   Frank “Shamy” Orton, January, 1899, Illinois
   Verna Orton, b. July 5, 1901

In 1900, “Frank” and “Drusilla” Orton were living in Greene County, Illinois.  Drucilla (Waltrip) Orton died on July 8, 1902.  James Orton married a second time to Mable Dawson Chocquette.  Mable was born on August 15, 1883 in White Hall, Illinois and is the daughter of George P. Chocquette and Ruth B. (Dawson) Chocquette.  James and Mable Orton were the parents of five children:

Orton died on September 6, 1936 in Naples, Illinois and was buried in the White Hall Cemetery in White Hall, Illinois.  Mable (Chocquette) Orton died on August 25, 1951 in Hillview, Illinois and was buried in the Pinetree Cemetery near Patterson, Illinois.  On June 13, 1912, Roscoe Orton married Marguerite Drumk.  Roscoe Orton died on April 12, 1962.  On January 22, 1918, Raymond Orton maried Mae Best.  Mae (Best) Orton died on November 8, 1919 in Denver, Colorado.  On March 28, 1921, Raymond Orton married a second time to Alice Gibson.  Verna Orton married Charles Woolbridge.  Frank Orton died in Idaho.  In December, 1930, Oran Orton married Leona May Woolbridge.  Oran Orton died on April 10, 1977.  Arthur Orton died as an infant on April 19, 1912 and was buried in the White Hall Cemetery.  Robert Orton married Matilda Thompson in Honolulu, Hawaii.  Robert Orton died on July 1, 1986.  On November 2, 1950, Ralph Orton married Helen Louise Martin in Jacksonville, Illinois.

JANE P. ORTON (2.10.5) is the daughter of Joseph Orton and Mary (Bryan) Orton.  Jane was born on November 4, 1818 in Tennessee.  On April 16, 1841, Jane Orton married Hiram Stark in Greene County, Illinois.  Hiram was born in 1810 in Tennessee and is the son of Jesse Stark.  The children of Hiram Stark are established in the probate records of his father, Jesse Stark.  Hiram Stark’s brother-in-law, Joseph Altum made the following statement: “now came Joseph Altum and suggested that Elijah H. Stark, Joseph M. Stark, Julia Ann Stark and Telitha Jane Stark minor children of Hiram Stark, deceased, are entitled to monies and credits from the estate of their grandfather, Jesse Stark.”  The probate records continue: “ordered that the guardianship of Elijah H. Stark, Joseph M. Stark, Julia Ann Stark and Telitha Jane Stark be granted to Joseph Altum.”  Hiram and Jane Stark were the parents of at least four children:

In 1860, “Janet” (Bryan) Starks was living with her brother, James M. Orton in Greene County, Illinois.  In 1880, “Jane E.” (Bryan) Starks was living with John and Julia Whetstone in Greene County, Illinois.  Jane (Orton) Stark died on November 21, 1883 in Greene County, Illinois and was buried there in the Rives Cemetery.

HENRY ORTON (2.10.6) is the son of Joseph Orton and Mary (Bryan) Orton.  Henry was born on February 22, 1820 in Tennessee.  On August 10, 1843, Henry Orton married Mary Ann Harbour in Greene County, Illinois.  Mary was born on December 19, 1825 in Kentucky and is the daughter of William Harbour and Frances (Brannon) Harbour.  Henry Orton changed his last name to “Orten.”  Henry and Mary Orten were the parents of eleven children:

NANCY CAROLINE ORTON (2.10.7) is the daughter of Joseph Orton and Mary (Bryan) Orton.  Nancy was born on January 10, 1821 in Williamson County, Tennessee.  On July 17, 1839, Nancy Orton married Thomas Brannan in Greene County, Illinois.  Thomas was born in 1820 in Kentucky and is the son of Dudley Brannan and Mary “Polly” Brannan.  Thomas Brannan’s brother, Willis Brannan, married Nancy Orton’s sister, Sarah Orton.  Thomas and Nancy Brannan were the parents of at least six children:

Baker in White Hall, Illinois.  John and Sarah Baker had four children:  -  Eva Baker,  -  George Baker,  -  Mary Baker,  -  Lucy Baker.  Sarah (Lakin) Baker died on March 28, 1929 and was buried in the White Hall Cemtery.  Eva Baker married J. F. Culbertson.  George Baker lived in Rockford, Illinois.  Mary Baker married Dr. J. C. Murdock.  Lucy Baker married Ernest Price.

On October 1, 1882, Serepta Lakin married William Blair.  William and Serepta Blair had one daughter:  -  Gertrude Blair.  William Blair died on January 18, 1911 and Serepta (Lakin) Blair died on February 27, 1926 in White Hall, Illinois.  Gertrude Blair married John Newland and they had one daughter:  -  Mary Ann Newland, b. 1915.  Gertrude (Blair) Newland died prior to February 27, 1926 (death of her mother).  The third daughter of Thomas and Mary Lakin married J. W. Trunnels.

SARAH ELIZABETH ORTON (2.10.9) is the daughter of Joseph Orton and Mary (Bryan) Orton.  Sarah was born in 1828 in Williamson County, Tennessee.  On September 11, 1845, Sarah Orton married Willis Dudley Brannan in Greene County, Illinois.  Willis was born in 1822 in Kentucky and is the son of Dudley Brannan and Mary “Polly” Brannan.  Willis Brannan’s brother, Thomas Brannan, married Sarah Orton’s sister, Nancy Orton.  Willis and Sarah Brannan were the parents of at least two children:

   Joseph M. Brannan, b. 1847, Illinois
   Mary Ann Brannan, b. 1849, Illinois

NANCY BRYAN (2.12) is the daughter of Samuel Bryan and Margaret (Morrow) Bryan.  Nancy was born on December 28, 1802 in North Carolina.  Nancy Bryan is not listed in the will of her father, Samuel Bryan and was not mentioned in the 1909 letter written by Washington C. Bryan.  The 1851 estate papers of Henry M. Bryan clearly state Nancy Pickard was the sister of Henry M. Bryan, that Nancy had one minor daughter (Nancy Pickard) and that Nancy Pickard died prior to 1851.  In 1838, Joseph Orton was appointed guardian of the children of his brother-in-law, George M. Pickard:  Nancy Bryan Pickard, Mary Jane Pickard, Joseph Henderson Pickard and Alexander Ewing Pickard.  This establishes that Nancy Bryan married George M. Pickard.  On December 18, 1830, Nancy Bryan married her cousin, George M. Pickard (51.6.7), in Davidson County, Tennessee.  George was born on September 22, 1807 in Orange County, North Carolina and is the son of Alexander Pickard and Jane (Morrow) Pickard.  The ceremony was performed by Levin Edney.  Also married that day by Levin Edney was Nancy Bryan’s brother, John M. Bryan (2.5).  Therefore, it probably was a double wedding or all the same Bryan relatives went to two marriage ceremonies that day.  The estate records of Henry M. Bryan indicate that Nancy (Bryan) Pickard died prior to 1851 and that she had one daughter:Nancy Pickard.  George and Nancy Pickard were the parents of at least one daughter:
